This instagram suddenly makes much more sense now.
50 Cent can rejoice as he has won the lawsuit against Q and his website Worldstarhiphop.com. Back in 2009, 50 sued the website for using his image on their header for a long duration of time, claiming that the photo misled his fans into believing that he ran the site.
A couple of days ago, a federal judge granted the G-Unit boss summary judgment on copyright and right of publicity claims. In doing so, the judge rejected affirmative defenses including fair use of the image. Reports Hollywood Reporter:
According to the ruling, “Defendants provide no authority to support the fair use of a celebrity’s image or likeness. This is not surprising, as a celebrity’s image, standing alone, only evokes that celebrity’s persona. Jackson’s image does not, by itself, describe anything about Defendants’ website.”
A copy of the entire case if available here.
